    Administrative Provision No. 331, dated April 2, 2020, for the appointment of the Accident Investigation Board regarding the incident between the vessel RESOLUTE and the NAIGUATÁ (GC-23).

    In the exercise of the powers conferred upon me by numeral 1 of Article 78, in conjunction with numerals 1 and 2 of Article 73, and numeral 13 of Article 74 of the Decree with Rank, Value, and Force of the Organic Law of Aquatic Spaces; in conjunction with Articles 9 and 89 of the Decree with Rank, Value, and Force of the Law of Marinas and Related Activities; and pursuant to Article 17 of the Organic Law of Administrative Procedures.

    WHEREAS

    The National Institute of Aquatic Spaces, as the management entity for policies issued by the Ministry of People’s Power for Transportation, exercises the Aquatic Authority and Administration in accordance with its legally assigned competencies, which include guaranteeing maritime safety and human life at sea within the scope of the Aquatic Jurisdictions through supervision and control.

    WHEREAS

    The Aquatic Authority has confirmed the occurrence of an incident on March 30, 2020, which warrants the initiation and substantiation of an investigation to determine the contributing factors, as well as its causes and effects, for the purpose of establishing any corresponding liabilities.

    WHEREAS

    It is a duty of the Aquatic Authority to form an Accident Investigation Board, composed of professionals with a recognized track record, to carry out the necessary technical evaluations of the events in an objective and impartial manner.

    THIS OFFICE,

    HEREBY DECREES

    Article 1. The ACCIDENT INVESTIGATION BOARD, is hereby appointed for the notification and substantiation of the incident that occurred on March 30, 2020, within the Aquatic Jurisdiction of Puerto Cabello.

    Article 2. The Accident Investigation Board shall be composed of the following citizens:

    Article 3. The Accident Investigation Board shall carry out all actions pertinent to an investigation and evaluation of the events occurred, for the purpose of preparing a report of results, which will be submitted for the consideration of the President of the National Institute of Aquatic Spaces, in order to adopt the corresponding measures and actions.

    Article 4. By virtue of the functions of the Accident Investigation Board referred to in this Administrative Provision, public and private organizations, as well as natural and legal persons related to the event, shall provide all necessary collaboration for the fulfillment of the objectives of the investigation.

    Article 5. This Administrative Provision shall enter into force upon its signing.
