    RULING No. 072, ARTISANAL MASTER LICENSE APURE

    ADMINISTRATIVE RULING No. 072
    CARACAS, NOVEMBER 10, 2021

    In exercise of the power conferred by article 78 numerals 1 and 12 of the Decree with Rank, Value, and Force of the Organic Law of Aquatic Spaces, pursuant to the provisions of articles 73 numerals 1, 2, and 18, and article 74 numerals 3, 4, 5, 13, and 29 eiusdem, in accordance with articles 245, numeral 1, literal h, and article 280 numeral 4 of the Decree with Rank, Value, and Force of the Law of Marinas and Connected Activities, article 34 of the Decree with Rank, Value, and Force of the Organic Law of Public Administration, and as provided for in article 17 of the Organic Law of Administrative Procedures.

    WHEREAS The National Institute of Aquatic Spaces, in exercise of the Aquatic Authority and Administration, must address the requirements of Seafarers in compliance with the applicable legal regulations, guaranteeing maritime safety and the protection of the environment, for which it is responsible for issuing documents that certify competence for the performance of their duties.

    WHEREAS The Apure Aquatic Jurisdiction comprises the states of Apure, Guárico, Barinas, Cojedes, Portuguesa, Táchira, and part of the Mérida State, and is further divided into 32 municipalities and 117 sectors, where the majority of the users served consist of a population dedicated to artisanal fishing as their main means of subsistence and, for the purpose of carrying out said activity, they must hold the title of Artisanal Master granted by the National Institute of Aquatic Spaces in accordance with the law.

    WHEREAS In accordance with the provisions of article 280 of the Decree with Rank, Value, and Force of the Law of Marinas and Connected Activities, it is established in its numeral 4 that the title of Artisanal Master is that which qualifies the holder to exercise command of artisanal or primitive types of vessels, as well as those specific to indigenous and peasant communities and coastal fishermen, of less than twenty-four meters (24 mts.) in length overall, within a specific aquatic jurisdiction.

    WHEREAS The processes established by the National Institute of Aquatic Spaces to obtain the title of Artisanal Master require making an application through the SINEA system, and the respective document is only issued through an electronic signature process which, once completed, reaches the user via their personal email.

    WHEREAS The Apure Aquatic Jurisdiction, due to its geographical location, experiences difficulties in securing an internet service connection, making it impossible to access the SINEA platform to upload user applications.

    WHEREAS The National Institute of Aquatic Spaces is responsible for the monitoring and control of activities carried out within aquatic spaces, for which it must implement the necessary actions and measures to guarantee maritime safety and environmental protection.

    WHEREAS The Decree with Rank, Value, and Force of the Organic Law of Aquatic Spaces establishes that the National Institute of Aquatic Spaces shall promote and incorporate the participation of local Community Organizations, socio-productive networks, and cooperatives, in addition to encouraging voluntary work, surveillance, and social accountability (“contraloría social”) in the services provided throughout everything related to the national aquatic space.

    HEREBY DECIDES
    Article 1. An Artisanal Master License is hereby established, which shall have a duration of two (2) years counted from its issuance, intended for Seafarers who crew artisanal or primitive types of vessels for subsistence purposes within the Apure Aquatic Jurisdiction, in accordance with the format set forth in this Administrative Ruling.
    Article 2. The Artisanal Master License qualifies the holder to operate, for subsistence purposes, metallic bongo-type, artisanal, or primitive vessels of less than twenty-four meters (24 mts.) in length overall within the indigenous, peasant, and coastal fishing communities of the Apure Aquatic Jurisdiction.

    Article 3. The form approved for the issuance of the Artisanal Master License is indicated below and contains the following information:

    1. Document Identification: Artisanal Master License
    2. Visible 3×3 size photograph of the applicant
    3. First Names
    4. Last Names
    5. Identity Card Number (Cédula de Identidad)
    6. License No.: (Registration code)
    7. Date of Issuance
    8. Expiration Date
    9. Name of the area served
    10. Document serial number (which must match the registration number)

    The reverse side of the License must contain the signature of the Port Captain of the Apure Port Captaincy, as well as the text mentioned below:

    “This License authorizes the holder to operate, for subsistence purposes, metallic bongo-type, artisanal, or primitive vessels of less than twenty-four meters (24 mts.) in length overall within the indigenous, peasant, and coastal fishing communities of the Apure Aquatic Jurisdiction. It is understood that if the holder takes actions that jeopardize the safety of navigation or cause damage to persons or third-party property, this license may be annulled or suspended. This License is valid for two (02) years from its issuance.”

It is understood that if the holder takes actions that jeopardize the safety of navigation or cause damage to persons or third-party property, this license may be annulled or suspended. PORT CAPTAIN APURE PORT CAPTAINCY Delegate according to Administrative Ruling No. 072 dated November 10, 2021 No. 00000 This License is valid for two (02) years from its issuance.

    Article 4. The code for the registration number to be carried by the Artisanal Master License shall be structured as follows:

    • LPA-ARSM-00000
      • LPA: Artisanal Master License (Licencia de Patrón Artesanal)
      • ARSM: Apure Port Captaincy
      • 00000: Sequential Number
    Article 5. To be granted the Artisanal Master License referred to in this Administrative Ruling, the Apure Port Captaincy must conduct Community Outreach Sessions (“Jornadas Sociales”), where artisanal fishermen will be provided with information regarding the fundamentals of navigation, marine engines, safety, and social responsibility.
    Article 6. The Port Captain of the Apure Captaincy must verify and shall act as a guarantor that the applicants for the Artisanal Master License are effectively artisanal fishermen belonging to the community and that the vessels are intended to fulfill subsistence activities, under the terms referred to in this Administrative Ruling; otherwise, the corresponding administrative actions shall be applied.
    Article 7. During the Community Outreach Sessions, the officials of the Apure Port Captaincy must request from each applicant a copy of their identity card and medical certificate, as well as have them complete the form “Competence Recognition Record as Apure Artisanal Master,” which must be signed and stamped by the Port Captain of Apure.
    Article 8. The signature of the Artisanal Master License is delegated to the Port Captain of Apure, who must make reference therein to the data of this Administrative Ruling.
    Article 9. The Artisanal Master License shall be prepared by the Apure Port Captaincy and signed by the Port Captain in situ during the Community Outreach Session, and shall have a duration of two (2) years counted from its issuance, which may be renewed for an additional two years subject to compliance with the requirements established for such purpose.
    Article 10. The Port Captaincy must open and maintain a file for each outreach session conducted, which must be kept updated, accessible, and auditable, containing a copy of the following documents: identity card, medical certificate, and the individual competence record of each applicant generated and signed by the Port Captain of the Apure Port Captaincy.

    Article 11. The Apure Port Captaincy, through the Documentation Coordination, must maintain a physical and digital registry logbook of the Artisanal Master Licenses issued, which must contain the following information:

    1. Document serial number: 00000
    2. First and Last Names of the Citizen
    3. Identity Card Number (Cédula de Identidad)
    4. Registration number of the License: LPA-ARSM-00000
    5. Date of Issuance
    6. Expiration Date
    7. Number and date of the Community Outreach Session: 000/00.00.0000
    8. Name of the area served
    9. Date of Renewal
    10. Remarks
    Article 12. The Apure Port Captaincy must send the digital registry of the issued Artisanal Master Licenses within the first 5 days of each month to the Seafarers Management, through the General Management of Marina.
    Article 13. The Artisanal Master License may be annulled or suspended when the holder takes actions that jeopardize the safety of navigation or cause damage to persons or property.
    Article 14. The General Directorate of Marine Affairs shall be responsible for ensuring compliance with the provisions of this Administrative Ruling.
    Article 15. This Administrative Ruling shall enter into force upon its notification.
