    Circular 085 dated May 10, 2023 – All interested parties are informed that Radio Inspections must be performed by Radio Inspectors registered and certified by INEA.

    CIRCULAR N° 085

    In exercise of the power conferred to me by Article 78 numeral 1 of the Decree with Rank, Value and Force of Organic Law of Aquatic Spaces, in accordance with Articles 73 numeral 1 and 2 and 74 numeral 3, 7, 13 and 29 ejusdem, pursuant to the provisions of Article 227 and 228 of the Decree with Rank, Value and Force of Law of Marinas and Related Activities, as provided for in Articles 4 and 12 numeral 4 of Ministerial Resolution No. 053 dated March 2000, published in the Official Gazette of the Republic of Venezuela, Value and Force of Law on Marinas and Related Activities, pursuant to the provisions of articles 4 and 12 numeral 4 of Ministerial Resolution No. 053 dated March 2, 2000, published in the Official Gazette of the Bolivarian Republic of Venezuela No. 36.904 of the same date, by means of which the Regulation to Establish the Powers of the Title of Nautical Administrator and the Requirements, Programs of Studies and Procedures for its Obtaining and for the Processing of the Licenses and Certificates of Merchant Marine in the Areas of Maritime Radiocommunications and Radiotelephony and in article 17 of the Organic Law of Administrative Procedures are dictated.
    This Office

    DECIDES

    1. Port Captains, Naval Inspectors, Auditors, Owners, Shipowners, Operators and, in general, all natural or juridical persons who work in the national aquatic sector, are hereby informed that the physical, documentary and technical Radio Inspections must be carried out by a Radiocommunications Inspector who is fully registered and certified by the Aquatic Authority, in order to verify compliance with the provisions contained in the Law Approving the International Convention for the Safety of Life at Sea (SOLAS), the Decree with Rank, Value and Force of Law on Marinas and Related Activities and other applicable regulations on the matter.
    2. When in an Aquatic Circumscription where the vessel to be inspected is located, there is no availability of Radiocommunications Inspectors, Naval Inspectors or “Naval Inspection Specialists” may be appointed, who must be accompanied by a radio technician with the competencies of law and provided with the necessary instruments for the purposes of the inspection, duly accredited by the companies registered before the National Institute of Aquatic Spaces and duly authorized by it, in accordance with the provisions of article 240 of the Decree with Rank, Value and Force of Law of Marinas and Related Activities.
    3. INEA Circular No. 005 dated April 25, 2019 is hereby repealed.
    4. Notify the content of this Circular through all dissemination mechanisms.
