CIRCULAR NO. 16
In exercise of the powers conferred upon me by article 78 numeral 1 of the Decree with Rank, Value, and Force of the Organic Law of Aquatic Spaces, in accordance with the provisions of articles 73 numerals 1 and 18, 74 numerals 1 and 3, ejusdem, and pursuant to the provisions of article 17 of the Organic Law of Administrative Procedures, by means of this Circular, all addressees of Administrative Ruling No. 055, dated August 22, 2017, issued by the National Institute of Aquatic Spaces, which defines the regulations for the selection of Marine Inspectors and Auditors, are hereby notified by this Office:
DECIDES:
1. Fishing vessels without a deck having a gross tonnage equal to or greater than 5 GT, but with an overall length of less than 12 meters, as well as artisanal vessels with a gross tonnage of less than 5 GT, including those of indigenous communities, those dedicated to artisanal and subsistence fishing as livelihood for the fisherman and their family group, tourism vessels, and human-propelled vessels, shall be subject to a safety inspection prior to registration in the Venezuelan Naval Registry and the issuance of the respective navigation license, which will be executed as follows:
a. The Port Captain of the jurisdiction where the registration in the Naval Registry is to take place shall designate an official from the Captaincy qualified to perform the inspection, which shall be governed according to the instructions included in ANNEX 1 “Safety Inspection Form for Fishing Vessels without a Deck with Gross Tonnage Equal to or Greater than 5 GT and Overall Length of Less than 12 Meters” and ANNEX 2 “Safety Inspection Form for Artisanal Vessels with Gross Tonnage of Less than Five 5 GT, Including those of Indigenous Communities, Those Dedicated to Artisanal and Subsistence Fishing as Livelihood for the Fisherman and Their Family Group, Tourism Vessels, and Human-Propelled Vessels.”

b. The inspections described above do not generate any type of disbursements or payments.
c. The Port Captain shall validate the inspection report and forward it in digital PDF format to the Maritime Safety Management of the National Institute of Aquatic Spaces at the email address inspecciones@inea.gob.ve, preserving a copy in the archives of the Port Captaincy.

2. Likewise, compliance must be met with the provisions of article 135 of the Decree with Rank, Value, and Force of the Law of Marinas and Connected Activities, regarding “determining, at least one (1) time during the validity of the licenses or restricted special permits, whether the vessels, personal watercraft, and other floating structures mentioned in the preceding paragraphs are in seaworthy conditions.”
3. Circular No. 018 dated September 9, 2018, is hereby revoked.
