    (Special Notice – 006 COVID-19)

    In the exercise of the powers conferred by Article 78, numeral 1 of the Decree with Status, Value, and Force of the Organic Law of Aquatic Spaces, in conjunction with Articles 73, numerals 1 and 2, and 74, numerals 3 and 16 ejusdem, and in accordance with the provisions of Article 17 of the Organic Law of Administrative Procedures.

    CONSIDERING
    That the President of the Bolivarian Republic of Venezuela, Nicolás Maduro Moros, has declared a permanent emergency in the national health system, for the purposes of strengthening prevention measures and avoiding the spread of the Coronavirus COVID 19 virus, in view of its arrival in our country,

    CONSIDERING
    The Decree with the Rank, Value and Force of Law on Maritime and Related Activities (LMAC), in its Article 37, establishes that “upon a vessel’s arrival at port and following the corresponding health inspection, it shall be visited by representatives of the aquatic authority, for the purpose of verifying the validity and current status of the vessel’s documentation in accordance with the law”.

    CONSIDERING
    That according to Circular No. 06 of the National Institute of Aquatic Spaces (INEA) dated March 13, 2020, the Aquatic Authority of the Bolivarian Republic of Venezuela establishes that protection level 1 is maintained in all port facilities in the country, and prevention measures are increased to avoid the contagion of the COVID-19 coronavirus.
    This Office, in view of the fact that the COVID-19 virus and its spread have shown a dynamic character, and in the interest of keeping the aquatic sector informed, readjusts the set of measures and, therefore:

    DECIDES
    Harbor Masters, within the framework of the Regional Port Facilitation Committee, must coordinate with regional health authorities to make the best decisions in order to avoid unnecessary delays for vessels and the movement of crews and cargo.

    4. For the embarkation and disembarkation of crew at national ports, the following shall be implemented:
    Shipping agencies shall report any intended crew changes:
    1. List of crew to be disembarked, indicating the travel itinerary for the last 30 days and a health status report, according to the symptoms that identify the presence of the COVID-19 virus in accordance with the parameters established by the WHO.
    2. List of crew members to be embarked, indicating their travel itinerary for the past 30 days and a health status report detailing symptoms indicative of COVID-19, in accordance with the parameters established by the WHO.
    Protection Level 1 is maintained throughout the national port system where reception and clearance of vessels on international voyages are carried out, increasing sanitary measures to prevent the spread and contagion of COVID-19.
    Until further notice, the departure of recreational vessels and gatherings of persons in recreational marinas are prohibited, as well as in establishments located along the coastal and riverine maritime zone.
    The Maritime Authority, through the Institute’s General Management of Operations, shall ensure strict compliance with this Circular.

    The Maritime Medicine Coordination Unit of the National Institute of Aquatic Spaces (INEA), together with designated maritime physicians, shall establish protocols for prevention, quarantine, isolation, and transfer of patients suspected of exhibiting COVID-19 symptoms, with emphasis on the preventive measures to be adopted by all persons involved in the ship-port interface.
    All persons involved in the ship-port interface are instructed to periodically consult the official WHO bulletins by following the link:
    https://www.who.int/emergencies/diseases/novel-coronavirus-2019/situation-reports/.
    It is established that, for the purpose of complying with the visit established in Article 37 of the Decree with Rank, Value and Force of the Law of Marinas and Related Activities, to verify the currency and validity of the vessel’s documentation, such documentation shall be requested via email and verified by the Harbor Master, thereby preventing the risk of infection associated with an in-person visit.
    This measure shall apply to all vessels, irrespective of their flag or the type of navigation undertaken; therefore, the statutory “in-person” inspection is suspended until further notice.
    Harbor Masters shall implement coordination measures with the respective shipping agents of the vessels, so that they send the required documentation along with the Notice of Arrival, complying with the following procedure:
    1. Consult daily the arrival notices of all vessels, irrespective of their flag, with emphasis on the port of origin, departure date from the last port, list of the last 10 ports visited, and the Maritime Declaration of Health (see Annex A).
    2. For arrival notices of vessels engaged in international traffic that include, in their list of the last 10 ports visited, any country with risk of COVID-19 transmission, or that depart from such a country, constant communication shall be maintained with the shipping agent prior to arrival and throughout the vessel’s port stay, remaining alert to any health-related reports from the Ship’s Master.
    Upon arrival and during the health inspection, the Ship’s Master shall be explicitly asked whether any crew member or passenger has exhibited symptoms indicative of COVID-19.
    1. Once the pre-arrival analysis has been carried out, and there is a suspicion of the presence of a case of introduction of the virus, the vessel shall be ordered to proceed to the quarantine zone designated by the Harbor Master, who will send the sanitary medical authorities to perform the respective health evaluation of the entire crew.

    Note: In the absence of a medical practitioner, the master should regard the following symptoms as grounds for suspecting the existence of an infectious disease:
    a) fever, persisting for several days or accompanied by: i) prostration; ii) decreased level of consciousness; iii) glandular swelling; iv) jaundice; v) cough or dyspnea; vi) unusual bleeding; or vii) paralysis; b) with or without fever: i) any acute skin rash or eruption; ii) severe vomiting (not caused by motion sickness); iii) severe diarrhea; or iv) recurrent convulsions.
